Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") defines the uses of Telv Communications' services that are permitted, the uses that are prohibited, and the consequences of violations. It applies to all clients, users, and any party that interacts with Telv's Site (telvcoms.com) or engages Telv's managed SMS compliance operations services.

By using the Site or Telv's services, you agree to comply with this AUP. Violations may result in immediate suspension or termination of services.

2. Permitted Uses

Telv's services are designed for, and may only be used by, businesses engaged in lawful commercial activities who seek to build and maintain compliant SMS messaging programs. Permitted uses include:

  • Engaging Telv for 10DLC brand and campaign registration preparation
  • Engaging Telv for toll-free number verification support
  • Engaging Telv for short code program compliance review and carrier documentation
  • Engaging Telv for ongoing managed compliance governance of active messaging programs
  • Submitting accurate and complete business and program information for provider review
  • Using the Site to submit intake inquiries and obtain information about Telv's services

3. Prohibited Uses

The following uses of Telv's services and the Site are strictly prohibited:

3.1 Regulatory and Legal Violations

  • Using Telv's services to support a messaging program that does not comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, state consumer protection laws, or applicable carrier policies
  • Submitting or requesting that Telv submit registration materials for a program that misrepresents the use case, message content, consent practices, or business identity to a provider, carrier, or registry
  • Using Telv's services to facilitate unsolicited commercial messaging to recipients who have not provided prior express consent
  • Engaging Telv for programs designed to evade carrier filtering, spam detection, or traffic monitoring systems

3.2 Fraudulent and Deceptive Activity

  • Providing false, misleading, or incomplete information to Telv for the purpose of registration preparation
  • Impersonating another business or individual in any communication or submission
  • Using fabricated, altered, or manipulated screenshots or documentation as opt-in evidence
  • Registering a program under a stated use case that does not reflect the messages that will actually be sent
  • Misrepresenting the nature of the client business or the identity of authorized contacts

3.3 Harmful and Prohibited Content

Engaging Telv for any program that involves, promotes, or facilitates:

  • Sexually explicit content, including adult content not compliant with carrier age-gating requirements
  • Illegal goods or services of any kind
  • Phishing, pretexting, social engineering, or identity theft
  • Financial fraud, including advance fee schemes, fake investment opportunities, or unauthorized debt collection
  • Controlled substances, counterfeit goods, or products sold in violation of applicable law
  • Gambling or gaming content not authorized under applicable law in the applicable jurisdiction
  • Content that promotes violence, harassment, discrimination, or hate based on race, ethnicity, religion, national origin, gender, sexual orientation, disability, or other protected characteristics

3.4 Program Integrity Violations

  • Sending messages to lists that were purchased, rented, or obtained from third parties without each recipient's independent prior express consent to receive messages from the specific sending business
  • Ignoring or circumventing opt-out requests
  • Re-messaging individuals who have previously opted out
  • Using a registered use case as a cover for a materially different actual use case

3.5 Site Misuse

  • Attempting to gain unauthorized access to Telv's systems, infrastructure, or other clients' data
  • Using automated tools, bots, or scrapers to access or extract data from the Site
  • Introducing malware, viruses, or any malicious code
  • Attempting to interfere with the availability or performance of the Site
  • Harvesting or collecting contact information from the Site for any purpose

4. Reporting Violations

If you believe that Telv's services are being misused or that this AUP is being violated, please report it to:

Reports should include a description of the suspected violation and any relevant information. Telv will review all reports and take appropriate action.

5. Enforcement

Telv reserves the right to investigate suspected violations of this AUP. Upon determining that a violation has occurred or is reasonably likely, Telv may, at its sole discretion:

  • Issue a written warning and require the client to remedy the violation within a specified period
  • Suspend service delivery pending investigation or remediation
  • Terminate the service engagement immediately without refund for violations involving fraud, misrepresentation, or content prohibited under Section 3.3
  • Report the violation to applicable carriers, registries, or law enforcement where required or appropriate
  • Pursue available legal remedies for damages caused by the violation

Telv's enforcement of this AUP does not create any obligation on Telv to monitor all client activities or to take action in every case.

6. No Limitation on Other Rights

Nothing in this AUP limits Telv's rights under its Terms of Service, Messaging Compliance Policy, or applicable law. Where this AUP and another Telv policy address the same subject, the more restrictive provision applies.

7. Updates

Telv may update this AUP to address new use cases, regulatory developments, or carrier policy changes. Updated versions will be posted to the Site with a new effective date. Continued use of Telv's services after the effective date of an update constitutes acceptance.
